Update: Bowie State Advisor Faced Child Abuse Charges, Died After Mental Breakdown

Update, 5:25 p.m.: A Bowie State academic advisor who faced accusations that he abused one of his children, his attorney said.

Annapolis attorney Keith Gross confirmed that police arrested Patrick Raphael Toney, 41, of Odenton, on child abuse charges on April 12. He was released on $15,000 bail on Friday.

Gross said that Toney's wife picked him up from the courthouse and that they parted ways when they got home to Odenton. On Friday evening, he was on his way to take care of some personal affairs when police found him parked near the corner of Piney Orchard Parkway and Odenton Road.

Original Post, noon: Anne Arundel County police are investigating the death of a Bowie State University advisor after he resisted arrest following a possible mental health episode last week.

Police rushed Patrick Raphael Toney, 41, to the hospital Friday after he was found acting irrational at a busy Odenton intersection, according to a police report.

Police said that Toney died Wednesday at Baltimore Washington Medical Center on Friday by officers who had shackled him when he began acting irrationally.

The episode began at about 5:50 p.m. Friday, when a patrol sergeant from the county’s Western District was driving near the and 7-Eleven on Piney Orchard Parkway and Odenton Road. The officer saw a Black Jeep Cherokee in the southbound lane stopped with its hazard lights flashing. Officers later identified Toney as the driver.

Police said the officer positioned her patrol car on the Odenton Road side of the intersection and saw Toney come out of the Cherokee and throw items out of the SUV and onto the ground. When the officer approached him, Toney said he wanted the officer to shoot him, and made other irrational statements. Police said he continued to act irrationally and walked into the roadway, causing danger to himself.

At this point, the sergeant determined that Toney may have been having a mental health emergency. She took him into custody, with the intention of taking him to the hospital for an evaluation, police said.

According to police, the sergeant and other officers on the scene attempted to handcuff Toney for their own safety and his. At that point, Toney began spitting at officers and flailed his legs in an attempt to hurt them. They eventually subdued him using leg shackles and a spit hood, and transported him to Baltimore Washington Medical Center. Toney attempted to kick out the windows of the car during the ride.

While on the way to the hospital, an officer noticed that Toney had become very quiet and unresponsive. When they arrived at the hospital, Toney was not breathing, but he was revived by hospital staff, police said.

Police learned that on Wednesday, Toney had passed away at the hospital. His body was transported to the Chief Medical Examiner’s officer for an autopsy.  The county’s Criminal Investigation Unit is investigating the case.

Toney, 41, was a resident of Piney Orchard and was employed as an academic advisor at Bowie State University. School spokesman Darisa Clarke said officials were "saddened" to learn of his death.

"He was a very caring advisor and was very well-liked by many students," Clarke said.
